The works listed on this invoice (less any exclusions listed) as performed by CANHAM PEST MANAGEMENT SERVICES or authorized servants of CANHAM PEST MANAGEMENT SERVICES, shall be warranted against faulty workmanship and reinfestation as a result, thereof for the period of Free Service noted overleaf, subject to the following terms and conditions.
CANHAM PEST MANAGEMENT SERVICES shall not be bound by the undertakings in the above unless the owner/purchaser complies with the following conditions:
a. That the owner/purchaser notifies CANHAM PEST MANAGEMENT SERVICES within ten (10) days of any such reinfestation becoming known to the owner/purchaser.
b. That the owner/purchaser does not introduce to the property any pest infested articles, furniture, fabrics, produce plants, foodstuffs, or other materials contributing to reinfestation.
c. That the owner/purchaser does not remove, wash away or otherwise cover any baits, powders, chemicals or treated areas, to the detriment of the works provided by CANHAM PEST MANAGEMENT SERVICES.
d. That the owner/purchaser complies with any requests by CANHAM PEST MANAGEMENT SERVICES or its authorized servants to remove or clean any factors, or to desist with any practices contributing to reinfestation of the pests treated.
a. In respect to termite treatment, the owner/purchaser agrees to maintain the areas treated, free from any factor contributing to reinfestation, such as wood, garden refuse, timber, direct wood/timber soil contact in the areas treated, water damage, or the introduction of stores, furniture or termite infested timbers, without those items first being treated by CANHAM PEST MANAGEMENT SERVICES at an additional service fee. It is also agreed to maintain the area treated, and not to make any alterations to the structure without notifying CANHAM PEST MANAGEMENT SERVICES prior to alteration as herein provided, also to eliminate faulty plumbing, leaks and dampness due to drains or drainage, condensation or leaks from the roof, or otherwise into, onto or under said areas treated. At no time will damage, caused to any portion of the structure, even by active termite infestation be the responsibility of CANHAM PEST MANAGEMENT SERVICES in areas where any of the conditions described in this paragraph exist.
b. In the event the premises above mentioned are structurally modified, altered or otherwise changed, after the date of the original treatment, this agreement shall terminate unless a prior written agreement shall have been entered into between the owner/purchaser and CANHAM PEST MANAGEMENT SERVICES to reinspect the premises, provide additional treatment and/or adjust the annual renewal service fee.
c. It is possible that damage may, as of the date of this order, exist in unexposed areas of the structure, or in areas which are inaccessible to visual inspection. For this reason, CANHAM PEST MANAGEMENT SERVICES cannot guarantee that the damage disclosed by visual inspection of the premises represents the entirety of the damage which may exist as of the date of initial treatment. It is specifically understood therefore, that CANHAM PEST MANAGEMENT SERVICES shall not be responsible for the repair or any damage, which existed in areas, or in structural members, which were not accessible for visual inspection as of the date of this order.
a. This order constitutes an offer to CANHAM PEST MANAGEMENT SERVICES, which it may accept or reject. If accepted by CANHAM PEST MANAGEMENT SERVICES it is agreed that the sole terms and conditions of the resultant contract are those set forth herein, other than those implied by law or agreed by the owner/purchaser and CANHAM PEST MANAGEMENT SERVICES in writing and that no other representations, free service periods or promises, are to be implied. The resultant contract shall be deemed to have been made at the registered office of CANHAM PEST MANAGEMENT SERVICES, in the state in which the property is situated. CANHAM PEST MANAGEMENT SERVICES shall deem performance by CANHAM PEST MANAGEMENT SERVICES of the treatment ordered as acceptance of this offer.
a. This Free Service period may be extended/renewed for additional period by the mutual consent of both parties, and the payment of the prescribed service fee.
b. CANHAM PEST MANAGEMENT SERVICES reserves the right to revise the Free Service renewal/service fee as of any anniversary.
a. Either party reserves the right to terminate this contract as of any anniversary date, by either advance by written notice to CANHAM PEST MANAGEMENT SERVICES or failure of owner/purchaser to pay annual service fee. These shall operate to automatically terminate this agreement.
a. Provided that all the above terms and conditions have been complied with.
b. Free Service to correct the cause of reinfestation as determined by CANHAM PEST MANAGEMENT SERVICES or its servants, shall be executed at no extra cost to the owner/purchaser.
c. A Free Service period will be supplied by CANHAM PEST MANAGEMENT SERVICES at an extra cost should paragraph 1, clause A, item b, not apply.
d. A free service period does not come into effect unless full payment of the relevant invoice has been received.
Some factors contributing to pest infestation, such as changing climatic conditions, seasonal plagues, and migrations of certain species of spiders and flying insects, being beyond the control of any human endeavor, may render some treatments only partially effective, where previous or subsequent treatments may well be quite acceptable.
